Subdivision: Special Option

What is the special subdivision option?

Where not more than five (5) lots or parcels will result after the subdivision is complete. Lots created in a Special Subdivision must meet the minimum residential density requirements for the applicable zoning district or each lot created must have a minimum lot size of at least one-half (1/2) acre in size, whichever is less.

How do I request special subdivision?

A special subdivision requires final plat approval only. The applicant must submit the following:

  1. Subdivision Application
  2. Final Plat (which meets the requirements of LDC Article XI, §200A-343 (A) ) prepared by a registered land surveyor (one (1) mylar and one (1) blue line copy). The Final Plat must contain the Certificate of Understanding for Special Subdivisions.
  3. Fee (See Fee Schedule)

Complete application(s), form(s) and plan(s) which meet the requirements of LDC Article III, §200A-74 and Article XI, §200A-337 , will be reviewed by the Subdivision Administrator (except where he/she refers the special subdivision for review by a higher approving authority (Technical Review Committee (TRC) or Planning Board)) who may sign off on the final plat. The signed plat must then be recorded at the Register of Deeds Office.

Can I use the special subdivision procedure a second time?

No more than five (5) lots within a five (5) year period shall be allowed within the boundaries of the tract that was the subject of the original special subdivision application. The special subdivision procedure may not be used in conjunction with an application for a minor subdivision or major subdivision.
