STATE OF NORTH CAROLINA           CANE CREEK WATER & SEWER DISTRICT

COUNTY OF HENDERSON                                                                               AUGUST 20, 2003

 

The Cane Creek Water & Sewer District Board met for a regularly scheduled meeting at 9:00 a.m. in the Commissioners’ Conference Room of the Henderson County Office Building at 100 North King Street, Hendersonville, North Carolina.

 

Present were: Chairman Grady Hawkins, Vice-Chairman Larry Young, Commissioner Charlie Messer, Commissioner Shannon Baldwin, County Manager David E. Nicholson, County Attorney Angela S. Beeker, and Clerk to the Board Elizabeth W. Corn.

 

Also present was County Engineer Gary Tweed.

 

Absent was:  Commissioner Bill Moyer.

 

Chairman Hawkins made the motion for the Board to adjourn as the Henderson County Board of Commissioners and convene as the Cane Creek Water & Sewer District Board.  All voted in favor and the motion carried.

 

Minutes

Draft minutes of the July 23, 2003 meeting were presented for Board review and approval.

 

Chairman Hawkins made the motion to approve the July 23 minutes as presented.  All voted in favor and the motion carried.

 

Mills River Interlocal Agreement

The Interlocal Agreement providing for the County to enforce the County’s ordinances within the Town of Mills River must be approved by the Board of Commissioners sitting as the Cane Creek Water and Sewer District. 

 

The Board was asked to refer back to the agenda item entitled “Mills River Incorporation - Draft Contract, Amendments to Cable Ordinance and Franchise” for a copy of the draft agreement under consideration.

 

Ms. Beeker spoke up that she had been debating this issue and actually Cane Creek does not administer any of the police power or land use ordinances; therefore, she didn’t feel the Board had to take action as Cane Creek. 

 

Following discussion, it was decided no action was necessary as Cane Creek.

 

Adjourn

Chairman Hawkins made the motion to adjourn as Cane Creek Water and Sewer District Board and reconvene as Henderson County Board of Commissioners.  All voted in favor and the motion carried.
